AGREEMENT BETWEEN HERO INSTITUTE AND THE PATIENT
These simple clauses will provide you with the information you need about our work methodology, and will serve as a guide in the resolution of doubts and/or conflicts that may arise.
DEPOSIT POLICIES
This document is a voluntary agreement between you as a Patient and HERO Institute as your ISP (Independent Service Provider) chosen to perform a hair restoration, medical or surgical procedure or scalp micropigmentation. By contracting HERO Institute’s services, you must have read and accepted the terms and conditions drafted in this agreement, since it lists the rights and obligations for both parties.
CLAUSE ONE. DEPOSIT.
To schedule a date for his procedure, the Patient must make a an advance payment of COP $2,000,000 or USD 500. This advance will be used, for the reservation of your surgical procedure, the operating room where the intervention will be carried out, as well as scheduling and staffing our team of nurses and medical personnel.
SECOND CLAUSE. PROCEDURE PAYMENT.
The procedure must be paid in full at least three (3) business days before the completion of said procedure, otherwise HERO Institute may make use of the space reserved to be used by another patient. In this case, it will be understood that the patient rescheduled his procedure and proceed according to clause three of this agreement.
THIRD CLAUSE. RESCHEDULING THE PROCEDURE.
Any rescheduling of the procedure by the Patient more than ten (10) calendar days in advance will not result in any type of economic penalty . If the patient reschedules the procedure within four (4) to ten (10) calendar days before the date agreed upon, 5% of the total value of the procedure will be retained (retainer fee). If the Patient reschedules three (3) days or less before the date agreed upon for the procedure, a 10% of the total value of the procedure (retainer fee) will be retained as compensation for administrative expenses and profit loss.
FOURTH CLAUSE. PROCEDURE CANCELLATION BY THE PATIENT.
Cancellations that occur more than seven (7) calendar days in advance will entitle HERO Institute to retain 5% of the value of the procedure for administrative expenses incurred.
Any cancellation of the procedure by the Patient between three (3) and seven (7) calendar days will entitle HERO Institute to retain 10% of the value of the procedure and it is understood as compensation for lost profits caused.
A retention of 25% of the value of the procedure will be made if the patient cancels up to forty-eight (48) hours prior to the procedure and it is understood as compensation for lost profits caused.
When payment is made by credit card, the patient will assume the commission; as well as the financial operating expenses and the TRM that are caused in any return.
FIFTH CLAUSE. WAIVER.
The patient voluntarily renounces to initiate any claim, judicial or extrajudicial, aimed at obtaining a refund of the discounted value of the advance. By making the first advance payment, you will be giving approval to HERO Institute’s return policy.
SIXTH CLAUSE. CONFIDENTIALITY.
Both the Patient and HERO Institute will maintain absolute confidentiality about this document and/or any data, materials, minor details, information, technical or commercial information that has been disclosed directly or indirectly in the development of the doctor-patient relationship. Any violation of this duty of confidentiality will entitle the other party to demand the full value of the damages suffered and demonstrable, as a result of the unfulfilled duty. This confidentiality clause legally binds both parties, not only during the execution of the contract but for up to two (2) additional years.
SEVENTH CLAUSE. PROTECTION OF PERSONAL INFORMATION.
HERO Institute assumes the constitutional, legal and jurisprudential obligation to protect the personal data accessed and processed on the occasion of this contract. Therefore, it must adopt the measures that allow it to comply with the provisions of Law 1581 of 2012 and its regulatory decree, Law 1266 of 2008, the latter as far as applicable to it. EIGTH CLAUSE. ORIGIN OF INCOME.
The Parties declare that both the resources used in the execution of the obligations assumed and in favor of this contract, as well as their income, products, goods and services, come from lawful activities, and are not in the process of extinction of ownership or at risk of being so; that the resources obtained under this contract will not be used for financing terrorism, financing or proliferating weapons of mass destruction; that it is not listed for control of money laundering, financing of terrorism, financing or proliferation of weapons of mass destruction, administered by any national or foreign authority or entity, such as the OFAC or official UN lists, in which consequently, is obliged to respond to the other party for all damages that may be caused as a result of non-compliance with this declaration.
NINTH. SAFEGUARD CLAUSE.
The clauses of this contract are independent and must be considered one by one, so that if any of them become invalid, illegal or unenforceable under any legal premise, it will be considered ineffective to the extent appropriate, but otherwise, this contract will retain its validity and effectiveness with respect to the rest of the content, stipulations and obligations. Both parties agree to replace the clause or clauses affected by invalidity, illegality or impossibility of execution with one or others that have the economic effects most similar to those replaced.
TENTH CLAUSE. STATEMENT OF ACCEPTANCE AND CONFORMITY.
The Patient expressly states that he has read this document in its entirety and that he agrees with each and every one of the conditions embodied here regarding the payment advance and its withholding if the procedure is not performed.
